Please note that we may periodically update our terms of sale policy, our any other policy contained herein and expressly reserves the rights to do so. All updates will become effective immediately. Use of the Website following the posting of revised Terms of Sale constitutes acceptance of and agreement to these Terms of Sale, including but not limited to any changes.

“Customer” or “User” or “You” means the individual or entity, including entity or individual’s representatives, agents, contractors, affiliates, employers, or employer when the individual is acting on behalf of its employer, purchasing the product and/or service from or through Customer Floors Design.

“Custom Floors Design” or “We” means Custom Floors Design, its agents, representatives, employees working on its behalf, or affiliates.

Material Amounts: A 2% variance on material widths is within tolerances and is agreed to be acceptable within the industry limits. The amount of materials sold is compatible with measurement of floor covering, Fabrics, Wallpaper and the material dimensions. Material overage of approximately 10% is required in order to cut, seam, and trim materials. In some instances, the amount of padding or underlayment installed may be less.

Inaccuracies: We endeavor to present the most up to date, accurate, most reliable information on our website at all times. However, there may be instances where our website has incomplete data, typo errors, or inaccuracies regarding some of our products, product prices, or product details. Such errors may affect the price and/ or availability of one or more products. Please note that any such errors are unintentional. However, Custom Floors Design, Inc. presents its content “as is” and makes no claims to its accuracy, either expressed or implied. Additionally, Custom Floors Design, Inc. reserves the right to refuse or cancel any orders placed for products listed at the incorrect price. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the incorrect price.

Product Color: Color match to samples will vary from dye lot to dye lot. Customer agrees to accept color variances that fall within industry established ranges. Shading, pooling, watermarking, shedding, fluffing or pile crushing do not constitute manufacturing defects. These are inherent characteristics of all pile carpeting, rugs and fabrics. Missing tufts in handmade rugs and carpets are not a defect and can be remedied by reinserting missing tufts by a qualified technician. Despite every effort to accurately duplicate each product’s color when shown on our website, actual colors may vary. Due to computer monitor resolution and color settings, subtle variations in color and surface texture may not be fully revealed when viewing products on our website. We make every attempt to give you a good representation of the available colors for each product available on our website or stores. For an accurate representation of product appearance, you should view a sample of the product in a store or request a sample of the product (if sample is available) to be sent to your home.

Indemnification: You agree to indemnify, defend, and hold harmless Custom Floors Design, Inc., its officers, directors, employees, agents, affiliates, licensors, and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions, or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your internet account.

Choice of Venue and Law: Custom Floors Design, Inc. and Customer agree that exclusive jurisdiction and venue regarding dispute arising under or relating to this Agreement shall be within the Commonwealth State of Massachusetts. This Agreement shall be interpreted under the laws of the State of Massachusetts.
